Welcome to Nutritist.us ("Company," "we," "our," or "us"). By accessing or using our website and services, you agree to comply with these Terms & Conditions ("Terms"). Please read them carefully before using our website.

1. General Terms

  • These Terms govern your use of Nutritist.us and the purchase of our products.
  • By using our Site, you confirm that you are at least 18 years old or have parental permission.
  • We reserve the right to update or modify these Terms at any time, and continued use of our Site constitutes acceptance of any changes.

2. Orders & Payment

  • All purchases made through our Site are subject to availability and acceptance by us.
  • We reserve the right to refuse or cancel any order at our discretion.
  • Prices are listed in USD and are subject to change without notice.
  • Payment must be made via our approved payment methods at checkout.
  • Subscription purchases are also governed by our Subscriptions & Cancellations policy, which sets out the renewal terms and how to cancel. If anything in these Terms differs from that policy, the Subscriptions & Cancellations policy governs.

3. Shipping & Delivery

  • Orders are processed within 1-2 business days and shipped via Amazon Multi-Channel Fulfillment (MCF).
  • Shipping times may vary based on location and carrier.
  • Subscription orders ship free, on the first order and on every renewal. One-time orders are charged a flat rate for standard shipping within the United States, shown at checkout before you pay. Full details are in our Shipping policy.
  • Lost or Stolen Packages: Once a package is marked as delivered by the carrier, Nutritist is not responsible for lost or stolen packages. Customers should contact the carrier directly for disputes.
  • Customers are responsible for providing accurate shipping details. If an order is undeliverable due to an incorrect address, the customer must cover reshipping costs.
  • Full shipping terms are set out in our Shipping policy. If anything in these Terms differs from that policy, the Shipping policy governs.

4. Returns & Refunds

Returns and refunds are governed by our Refunds & Returns policy. The summary below is provided for convenience only. If anything in these Terms differs from the Refunds & Returns policy, that policy governs.

  • We offer a hassle-free refund policy for first-time customers under the conditions set out in the Refunds & Returns policy.
  • Within a single order, one opened bottle is eligible for a refund. Any additional opened bottles in that same order are non-refundable.
  • Unopened, sealed bottles from a first order may be returned. Unopened bottles may be returned only once per customer or household, ever.
  • Refund eligibility is limited to one person per household at the same mailing address, and to one refund per household, ever.
  • Customers must pay return shipping costs, and original shipping fees are non-refundable. Where a return is approved, only the product cost is refunded.
  • Refund requests must be made within 30 days of the original purchase date, and a Return Merchandise Authorization (RMA) number must be obtained before mailing a return.
  • These limits apply to product returns. They do not apply to a subscription order that was charged after you cancelled. Those are refunded in full, and the bottles do not need to be returned.

5. Use of Website & Content

  • All content on Nutritist.us, including text, images, logos, and trademarks, is owned by Nutritist and is protected under U.S. copyright and trademark laws.
  • You may not copy, distribute, modify, or use our content without prior written permission.
  • Unauthorized use of our Site for fraudulent or unlawful purposes is strictly prohibited.

6. Privacy & Data Collection

  • We collect and process personal information per our Privacy Policy.
  • We use tracking tools, including Facebook/Meta Pixel, TikTok Pixel, and Pinterest Tag, to improve advertising and user experience.
  • You can manage cookie preferences through your browser settings or opt out of targeted advertising on respective platforms.

7. Disclaimers & Limitation of Liability

  • No Medical Advice: Nutritist products are dietary supplements not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional before use.
  • Limitation of Liability: Nutritist is not responsible for any indirect, incidental, or consequential damages arising from the use of our products or Site.
  • No Warranties: We provide our Site and products "as is" without warranties of any kind, express or implied.

8. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict of law principles.
  • Any disputes shall be resolved through binding arbitration in Orange County, Florida, except where prohibited by law.
  • The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA).
  • Customers waive their right to participate in class-action lawsuits against Nutritist.
  • Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts located in Orange County, Florida.
